BH Miami Group LLC, doing business as Your Next Fund (“Your Next Fund,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, share, protect, and retain information through the Your Next Fund website, Apply Now process, secure application system, and related business-financing services.

1. Our Services

Your Next Fund is a business-financing platform and intermediary. We help businesses explore commercial financing options through a network of third-party financing and funding partners. Your Next Fund is not the direct lender.

Our services are for business-purpose financing only. Applications are accepted only from businesses located in the United States.

Anyone submitting information must be authorized to act for the applicable business and provide information concerning its owners.

2. Information We Collect

The information we collect depends on how you interact with us and how far you proceed through the application process.

Contact and Business Information

  • First and last name, business name, email address, telephone number, and addresses
  • Business type, industry, ownership information, time in business, and revenue
  • Requested financing amount, intended use of funds, and existing business-financing obligations
  • Other information concerning the business and its financing needs

Owner and Identity Information

  • Ownership percentage and business role
  • Residential address, date of birth, and Social Security number
  • Government-issued identification
  • Information used to verify identity, ownership, or authority to act

Financial and Application Information

  • Business bank statements and account information contained in submitted documents
  • Voided checks, signed business funding applications, and electronic-signature records
  • Existing financing information and supporting documents
  • Financing-partner requirements and responses

Communications and Call Recordings

Your Next Fund records telephone calls. We may collect and retain call recordings; call date, time, duration, and participant information; application-related emails and text messages; notes and correspondence; communication preferences; and consent, notice, delivery, and response records.

Required call-recording notices and consent procedures will be provided in accordance with applicable law.

At launch, our communications consist of individual, application-related telephone calls, emails, and text messages. We do not describe these communications as automated or promotional communications.

Technical and Security Information

  • Internet Protocol address and browser or device information
  • Session, authentication, application-progress, upload, and download information
  • Security, fraud-prevention, rate-limit, and replay-protection events
  • Dates and times associated with submissions, signatures, and communications

3. How We Collect Information

We collect information directly from applicants, owners, and authorized business representatives; through the Website Apply Now process and secure Your Next Fund CRM application; through submitted documents and electronic signatures; through individual application-related communications; from financing partners evaluating a controlled submission; and automatically when needed to maintain sessions, prevent abuse, secure the service, and preserve audit records.

The Website Apply Now process collects initial contact and business information and transfers the applicant into the secure Production CRM application. The process is designed to continue the same Lead and Application rather than creating a separate email-based or parallel intake record.

4. How We Use Information

We may use information to:

  • Create, maintain, and process an application
  • Understand the business’s financing needs and verify identity, ownership, and authority
  • Request and review information and documents
  • Communicate about an application or existing business-financing relationship
  • Identify potentially relevant financing options and prepare controlled partner submissions
  • Receive and organize financing-partner responses
  • Facilitate closing, servicing, and support
  • Maintain signed, consent, transaction, and audit records
  • Prevent fraud, abuse, duplicate submissions, and unauthorized access
  • Secure, test, maintain, and improve our systems
  • Investigate disputes or security incidents and comply with applicable obligations

Financing decisions, terms, and approvals are made by third-party financing partners. Submission of an application does not guarantee approval or funding.

5. Calls, Emails, and Text Messages

Your Next Fund records telephone calls for purposes that may include application processing, customer service, quality assurance and training, security and fraud prevention, consent verification, dispute resolution, and recordkeeping.

Recording notices and consent will be handled as required by applicable law.

We may use the contact information an applicant provides for individual communications concerning an application or existing business-financing relationship. These communications may include requests for information, document reminders, status updates, scheduling, financing-partner responses, security notices, and servicing communications.

Message and data rates may apply to text messages. Communication preferences may be submitted using the contact information below, subject to communications reasonably necessary to administer an existing request or relationship.

6. How We Share Information

Authorized Your Next Fund Personnel

Authorized personnel may access applicant information according to their responsibilities, organization, role, and system permissions.

Financing Partners

We may submit relevant information to selected financing or funding partners so they can evaluate or process a business-financing request. A controlled partner submission may include business, owner, identity, financial, document, and application information reasonably necessary for evaluation.

Verified Operational Service Providers

We may use verified service providers that support website and application hosting, database and authentication services, private file storage, encrypted backup and recovery, infrastructure and security, transactional authentication email, and other approved operational services.

Providers should receive only the information reasonably necessary to perform their authorized functions. Applicant information is not intended to be provided to an outside processor, contractor, consultant, call center, or document reviewer unless that party’s role, access, security controls, and service relationship have been verified and approved.

Legal and Security Requirements

We may disclose information when reasonably necessary to comply with applicable law or legal process; respond to a lawful government request; detect or prevent fraud or unlawful activity; protect applicants, Your Next Fund, financing partners, or others; investigate security incidents; establish, exercise, or defend legal claims; or complete an authorized corporate transaction with appropriate protections.

7. Cookies and Session Technology

We use essential cookies and similar technology needed to maintain secure sessions, authenticate authorized users, preserve application progress, protect against replay or unauthorized access, enforce rate limits, and support security and operational functions.

Additional analytics, advertising, or nonessential technologies will require review and an update to this Policy before activation where appropriate.

8. Information Security

We use administrative, technical, and organizational safeguards designed to protect information, including private file storage; organization- and role-based access controls; database row-level protections; secure session handling; short-lived authorized file access; encryption for designated sensitive information; upload authorization; file-size, file-type, MIME, extension, and file-signature validation; unsupported and executable-file rejection; security and audit controls; and encrypted backup and recovery procedures.

No system can guarantee complete security.

The initial launch configuration does not use an external third-party malware scanner. Uploaded files are validated and protected by access controls, but they are not represented as externally antivirus-scanned or certified malware-free.

9. Data Retention

Our intended policy is to retain applicant and client information only while reasonably necessary to process and service the applicable business-financing relationship.

Information may be retained longer when reasonably necessary for legal or regulatory obligations, contractual requirements, fraud prevention, security and incident response, disputes or legal claims, consent and communication records, signed applications and electronic-signature evidence, audit and transaction history, or backup, recovery, and business continuity.

Retention may differ based on the type of record, including incomplete applications, completed applications, declined files, documents, signed records, communications, call recordings, consent records, security logs, and backups.

10. Privacy Requests

Subject to applicable law and appropriate identity verification, individuals may contact us to request information about their personal information or ask that it be corrected or deleted.

A request may be limited when information must or may be retained to comply with law, preserve signed or transaction records, protect security, prevent fraud, resolve disputes, enforce agreements, or maintain required audit or backup records.

11. Third-Party Services

Financing partners and other third parties may maintain their own terms, privacy practices, and security procedures. This Privacy Policy does not govern an independent third party’s website or its independent handling of information after an authorized submission.

12. Changes to This Policy

We may update this Privacy Policy when our services, practices, providers, or legal obligations change. The current version will be identified by the “Last Updated” date shown above.
