1. Acceptance of These Terms

By accessing or using the website or submitting information through the Apply Now or application process, you agree to these Terms and acknowledge the Your Next Fund Privacy Policy.

If you do not agree, do not use the website or submit an application.

2. Business-Purpose and Geographic Eligibility

Your Next Fund’s services are intended solely for business-purpose financing. Applications are accepted only from businesses located in the United States.

By submitting an application, you represent that:

• You are authorized to act for the identified business
• The financing request is for a business or commercial purpose
• The information you provide is accurate and complete to the best of your knowledge
• You are authorized to provide information concerning the business and its owners
• You will not use the service for an unlawful, fraudulent, personal, family, or household purpose

3. Your Next Fund’s Role

Your Next Fund is a business-financing platform and intermediary. Your Next Fund is not the direct lender.

We help businesses submit application information, explore commercial financing options, and communicate with third-party financing and funding partners.

Financing is provided, if at all, by third-party partners and is subject to their underwriting, eligibility requirements, approval, documentation, and final terms. Nothing on the website guarantees approval, funding, a particular funding amount, pricing, timing, or availability.

4. Apply Now and the Application Process

The Apply Now process initially requests first name, last name, business name, email address, and telephone number. After the initial step, an applicant continues through the secure Your Next Fund CRM application.

The application may request business and ownership information, financial information, Social Security number and date of birth, bank statements, identity and supporting documents, electronic signatures, and other information reasonably required to process the request.

The Apply Now and CRM application flow is intended to create and continue one authoritative Lead and Application. It is not an email-based or parallel intake process.

You are responsible for reviewing submitted information and promptly correcting material errors. Save-and-resume functionality is intended to return an authorized applicant to the same application. You are responsible for protecting access to recovery links, email accounts, sessions, and devices.

5. Authorization to Process an Application

By asking Your Next Fund to process a business-financing request, you authorize us to use submitted information to create and maintain the application; verify information and authority; communicate about the request; review submitted documents; identify potentially relevant financing options; prepare controlled submissions to selected financing partners; receive and organize financing-partner responses; and maintain appropriate signed, consent, security, and audit records.

A financing-partner submission may include business, ownership, identity, financial, document, and application information reasonably necessary for that partner to evaluate the request.

6. Communications

Your Next Fund may communicate with applicants through individual, application-related telephone calls, emails, and text messages. Communications may concern application status, missing information, document requests, scheduling, financing-partner responses, security, closing, or servicing of the business-financing relationship.

These Terms do not describe or authorize automated dialing, prerecorded promotional calls, bulk text messaging, or promotional marketing campaigns.

Message and data rates may apply to text messages. Applicants may submit communication preferences to support@yournextfund.com, subject to communications reasonably necessary to process or administer an existing request or relationship.

7. Telephone Call Recording

Your Next Fund records telephone calls. Recordings may be used for application processing, customer service, quality assurance and training, security and fraud prevention, consent verification, dispute resolution, and recordkeeping.

Recording notices and consent will be provided or obtained as required by applicable law.

8. Electronic Signatures and Records

The application process may allow electronic signatures and electronic delivery of records. By completing an electronic-signature process, you intend to sign the associated record electronically and agree that the electronic signature may be associated with the applicable application and related records.

You should review all information and disclosures presented during the signature process before signing.

9. Documents and Uploads

Documents must be submitted only through approved upload methods. You may not upload executable files, malicious code, files unrelated to the application, unlawful material, information or documents you are not authorized to provide, or material intended to interfere with or compromise the service.

Uploaded files may be subject to authorization, size, format, MIME, extension, and file-signature validation.

The initial launch configuration does not include third-party antivirus or malware scanning. A validated document status does not mean a file has been externally antivirus-scanned or certified malware-free.

10. Acceptable Use

You may not:

• Provide false, misleading, fraudulent, or unauthorized information
• Impersonate another person or business
• Attempt to access another applicant’s records
• Circumvent authentication, authorization, security, or rate limits
• Interfere with the website or application system
• Test system vulnerabilities without written authorization
• Introduce malicious or harmful content
• Scrape or commercially exploit protected website content unlawfully
• Use the service in violation of applicable law

We may restrict access when reasonably necessary to protect applicants, financing partners, systems, or legal rights.

11. Financing and Educational Information

Website articles, examples, funding descriptions, and educational resources provide general information only. They do not constitute a financing approval, binding offer, commitment to fund, legal advice, tax advice, accounting advice, investment advice, or a guarantee that a particular product is available or suitable.

Actual financing terms are established by the applicable financing partner and may differ from general website information.

12. Third-Party Financing Partners

Financing partners are independent third parties and may maintain their own underwriting standards, eligibility requirements, terms and conditions, privacy practices, document requirements, and approval and funding processes.

Applicants should review all partner-provided terms before accepting a financing product.

13. Intellectual Property

The Your Next Fund name, original website design, text, graphics, and other owned content are protected by applicable intellectual-property laws.

You may use the website for legitimate evaluation of Your Next Fund’s services. You may not reproduce, distribute, modify, or commercially exploit protected content without permission, except as allowed by law.

14. Availability and Security

We work to maintain the availability and security of the website and application process, but uninterrupted or error-free operation cannot be guaranteed.

We may suspend or limit access when reasonably necessary for maintenance, security, legal compliance, fraud prevention, or protection of users and systems.

15. Privacy and Retention

Our collection, use, disclosure, protection, and retention of information are described in the Privacy Policy.

Applicant and client information is intended to be retained only while reasonably necessary to process and service the applicable business-financing relationship, subject to longer retention for legal, regulatory, contractual, fraud-prevention, security, dispute, consent, signed-record, audit, or backup purposes.

16. Changes to These Terms

We may update these Terms to reflect changes in the website, services, business practices, or legal requirements. The current version will be identified by the “Last Updated” date shown above.
